Terms of Service

1. The Service

The Service is a software add-on for Google Sheets™ that provides a library of in-cell functions for performing financial technical analysis.

2. Eligibility

The Service is not intended for users that are consumers (being an individual acting primarily for purposes other than a trade, business, or profession) and the applicability of consumer protection legislation is therefore excluded. You must be 18 years of age or older to enter into this agreement and use the Service.

3. Use Restrictions

Your right to use the Service is personal, non-transferable, non-exclusive, and revocable. You will not, and will not permit anyone else to: (a) copy, modify, or distribute the Service; (b) reverse engineer, decompile, or attempt to extract the source code of the Service; (c) use the Service for any unlawful purpose.

We may at any time suspend or terminate your access to the Service if we have reason to believe that you are not complying with the Terms or you are otherwise abusing the Service.

4. Modifications to the Service

DeusHarvest reserves the right to modify or discontinue, temporarily or permanently, all or part of the Service without notice at our sole discretion. We will not be liable to you or to any third party for any modification or discontinuance of the Service.

5. Trademarks and Ownership

DeusHarvest and the DeusHarvest logos are trademarks of DeusHarvest. All other trademarks, logos, and service marks displayed on the Service are the property of their respective owners. DeusHarvest and its licensors own all right, title, and interest, including all intellectual property rights, in and to the Service.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

DEUSHARVEST EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE ERROR-FREE OR THAT THE RESULTS AND DATA OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE. ANY DECISIONS YOU MAKE BASED ON THE DATA PROVIDED BY THIS SERVICE ARE YOUR SOLE RESPONSIBILITY. YOU USE THIS SERVICE AT YOUR OWN RISK.

7. Limitation of Liability

DEUSHARVEST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR MAXIMUM TOTAL LIABILITY FOR ALL CLAIMS UNDER THESE TERMS IS LIMITED TO 100 USD.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
